Terms of service

OVERVIEW

This website is operated by Stylingo (Pty) Ltd, a company registered in South Africa, trading as Stylingo. Throughout this website, the terms “Stylingo”, “we”, “us” and “our” refer to Stylingo (Pty) Ltd.

These Terms of Service govern your access to and use of stylingo.co.za, including any purchases made through our T-Shirt Collections and any enquiries or orders relating to promotional, corporate or custom-branded products and services.

By accessing or using this website, placing an order, submitting an enquiry or otherwise using our services, you agree to be bound by these Terms of Service together with any other policies referred to on this website, including our Privacy Policy, Shipping Policy and Refund Policy.

If you do not agree to these Terms of Service, you should not use this website or place an order through it.

We may update these Terms of Service from time to time. The version published on this website at the time of your transaction will apply to that transaction unless otherwise required by law.

SECTION 1 - ONLINE STORE TERMS

By using this website or placing an order with Stylingo, you confirm that you have the legal capacity to enter into a binding agreement. If you are under the age of 18, you may only use this website or place an order with the involvement and consent of a parent or legal guardian.

You may use this website only for lawful purposes. You may not use the website, our products or our services in any way that violates applicable law, infringes the rights of another person, or interferes with the security or operation of the website.

You may not introduce viruses, malicious code or other harmful material, attempt to gain unauthorised access to the website or its systems, or deliberately interfere with the website’s normal operation.

We may suspend or restrict access to the website where reasonably necessary to protect Stylingo, our customers, our systems or other users from fraud, unlawful activity, security threats or misuse.

SECTION 2 - GENERAL CONDITIONS

Our products and services are offered subject to availability and applicable law.

We may decline, suspend or cancel an order where reasonably necessary, including where there is a stock or pricing error, suspected fraud or misuse, a legal or regulatory restriction, or where we are unable to fulfil the order as agreed. If we cancel an order after payment has been received, any amount due to you will be refunded in accordance with applicable law and our Refund Policy.

Nothing in these Terms permits Stylingo to refuse service or discriminate against any person in a manner prohibited by law.

Your personal information is handled in accordance with our Privacy Policy. Payment information is processed through the secure payment methods and service providers made available through our website.

All website content, including text, graphics, photographs, product designs, branding, logos and other material, belongs to Stylingo or is used by us with permission and is protected by applicable intellectual property laws. You may view and use the website for personal, non-commercial purposes. You may not reproduce, distribute, sell, exploit or commercially use our website content without our prior written permission.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We take reasonable care to ensure that the information on this website, including product descriptions, specifications, pricing, availability and other content, is accurate and up to date.

From time to time, information may contain typographical errors, inaccuracies or omissions. Where we become aware of an error, we may correct or update the information as soon as reasonably possible.

Images are intended to represent our products as accurately as possible. Colours and appearance may vary slightly depending on screen settings, product batches, materials, printing methods and other production factors.

Information relating to promotional, corporate and custom-branded projects is provided as general guidance only. Final specifications, quantities, pricing, branding methods, production requirements and delivery arrangements will be confirmed in the relevant quotation or order confirmation.

Nothing in this section limits any rights available to you under applicable South African consumer law.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices displayed on our website are shown in South African Rand unless otherwise stated and include applicable taxes where indicated.

We may change product prices, product ranges, specifications or availability from time to time. Any changes will apply prospectively and will not affect an order that has already been accepted and paid for, except where permitted or required by law.

If a displayed price contains an inadvertent and obvious error, we may correct the error and take reasonable steps to notify affected customers of the correct price. This reflects the Consumer Protection Act’s treatment of obvious pricing errors.

Promotional, corporate and custom-branded projects are quoted individually. Unless otherwise stated in the quotation, pricing is based on the quantities, specifications, branding methods, delivery requirements and other information supplied at the time of quotation. Changes requested after quotation or approval may result in revised pricing, production timelines or both.

Where delivery, branding, setup or other charges apply, these will be disclosed before the transaction is concluded. South Africa’s electronic-commerce rules require online suppliers to disclose the full price, including applicable transport costs, taxes and other charges.

SECTION 5 - PRODUCTS OR SERVICES (if applicable)

Products displayed on our website may be available in limited quantities and are subject to stock availability. We may discontinue, replace or update products from time to time.

We take reasonable care to present product colours, images, specifications and descriptions as accurately as possible. Actual colours and appearance may vary slightly depending on screen settings, materials, production batches and printing or branding methods.

T-Shirt Collection products are supplied according to the product information, sizing and specifications displayed on the relevant product page.

Promotional, corporate and custom-branded products are produced according to the specifications, artwork, branding method, quantities and other requirements confirmed in the relevant quotation, artwork approval or order confirmation. Minor variations may occur where they are reasonably inherent in the manufacturing, printing, embroidery or branding process.

Where samples, proofs or artwork approvals are provided, it is the customer’s responsibility to check and approve the relevant details before production begins, including spelling, colours, logos, positioning, quantities and sizes.

Nothing in these Terms excludes or limits your rights under applicable South African consumer law. Consumers are entitled to goods that are reasonably suitable for their intended purpose, of good quality, free of defects and durable for a reasonable period, subject to the circumstances of supply.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

When placing an order or submitting an enquiry, you agree to provide information that is accurate, complete and reasonably up to date so that we can process your order, communicate with you and arrange delivery where applicable.

You are responsible for checking your order details before submitting your order, including product selection, size, quantity, delivery information and contact details.

We may review, limit or cancel an order where reasonably necessary, including where we identify suspected fraud, misuse, duplicate orders, unusually large quantities, resale activity, payment issues or incorrect customer information. Where an order has already been paid for and is cancelled by us, any amount due to you will be refunded in accordance with applicable law and our Refund Policy.

For promotional, corporate and custom-branded orders, the information contained in the approved quotation, artwork approval and order confirmation will form the basis of production. Customers are responsible for checking those details carefully before approval.

Personal information supplied to us is handled in accordance with our Privacy Policy and applicable data-protection law, including POPIA.

SECTION 7 - OPTIONAL TOOLS

Our website may make use of third-party tools, applications, payment services, integrations or other services that help us operate the website, process transactions or provide functionality to customers.

These third-party services may be subject to their own terms, conditions and privacy policies. Where you choose to use a third-party service made available through our website, your use of that service may also be governed by the relevant provider’s terms.

We take reasonable care in selecting the service providers and tools used on our website, but we do not control third-party platforms or services and cannot guarantee that they will always be available, uninterrupted or error-free.

Nothing in this section excludes or limits any rights you may have under applicable law.

SECTION 8 - THIRD-PARTY LINKS

Our website may contain links to third-party websites or services for convenience, information or functionality.

These websites are operated independently of Stylingo and are not under our control. The inclusion of a link does not necessarily mean that Stylingo endorses, approves or accepts responsibility for the third-party website, its content, products or services. This is consistent with the way South African public-sector websites treat external links.

If you choose to visit or use a third-party website, you do so subject to that website’s own terms, conditions and privacy policies.

Stylingo is not responsible for the content, availability or operation of third-party websites, except to the extent that liability cannot lawfully be excluded.

If you have a complaint or query regarding a product or service supplied directly by a third party, you should contact that third party in the first instance.

SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

You may from time to time submit reviews, feedback, testimonials, photographs, comments, suggestions or other content to Stylingo through our website, email, social media or other communication channels.

You remain responsible for the content you submit and confirm that it is accurate, lawful and does not infringe the intellectual property, privacy or other rights of any third party.

You may not submit content that is unlawful, defamatory, threatening, discriminatory, abusive, obscene, fraudulent, misleading or that contains malicious code or other harmful material.

Where you submit a review or feedback through a third-party review platform, your submission may also be subject to that platform’s own terms and privacy policy.

We may moderate, decline to publish or remove customer-submitted content where reasonably necessary, including where it is unlawful, misleading, abusive, irrelevant, fraudulent or infringes another person’s rights.

We will not publish identifiable customer photographs, testimonials or other personal content for promotional or marketing purposes without appropriate permission or another lawful basis to do so. Personal information contained in customer submissions will be handled in accordance with our Privacy Policy and applicable data-protection law.

Submitting feedback or suggestions does not create any obligation on Stylingo to implement, respond to or compensate you for those suggestions unless otherwise agreed in writing.

SECTION 10 - PERSONAL INFORMATION

We process personal information in accordance with our Privacy Policy and applicable South African data-protection law, including the Protection of Personal Information Act, 2013 (POPIA).

Personal information may be collected and used where reasonably necessary to process orders, respond to enquiries, arrange delivery, provide customer support, manage accounts, prevent fraud and comply with legal obligations.

Further information about how Stylingo collects, uses, stores, protects and shares personal information, as well as your rights in relation to your personal information, is set out in our Privacy Policy.

POPIA establishes conditions for the lawful processing of personal information, and the Information Regulator is responsible for monitoring and enforcing compliance.

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS

We take reasonable care to ensure that information published on our website is accurate and up to date. However, typographical errors, pricing errors, omissions or other inaccuracies may occasionally occur.

Where we identify an error, we may correct or update the relevant information as soon as reasonably possible.

If an error affects an order you have already placed, we will take reasonable steps to contact you and explain the available options. Where appropriate, this may include confirming the corrected information, cancelling the affected item or order, or issuing a refund.

Nothing in this section limits any rights available to you under applicable South African consumer law.

SECTION 12 - PROHIBITED USES

You may not use the Stylingo website, its content or services:

  • for any unlawful, fraudulent or unauthorised purpose;
  • to infringe the intellectual property, privacy or other legal rights of Stylingo or any third party;
  • to submit false, misleading or fraudulent information;
  • to upload, transmit or distribute viruses, malicious code or other material that may damage or interfere with the website, its systems or other users;
  • to attempt to gain unauthorised access to the website, customer accounts, servers, networks or other systems connected to the website;
  • to collect, scrape or extract personal information or website content by automated or unauthorised means;
  • to send spam, phishing messages or other unsolicited or deceptive communications;
  • to impersonate another person or misrepresent your identity or affiliation;
  • to interfere with or bypass security features, access controls or other protections used on the website; or
  • to use the website in a way that is abusive, threatening, discriminatory, defamatory or otherwise unlawful.

We may restrict or suspend access to the website where reasonably necessary to prevent or respond to unlawful activity, fraud, security threats or misuse.

Nothing in this section limits any rights or remedies available under applicable law.

SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We take reasonable steps to keep the Stylingo website secure, accurate and available. However, we cannot guarantee that the website will always operate without interruption, delay, technical error or temporary unavailability.

To the extent permitted by applicable law, Stylingo will not be liable for indirect, incidental or consequential loss arising solely from the use of, or temporary inability to access, this website where that loss was not reasonably foreseeable or was caused by circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law, including rights arising under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable legislation.

Nothing in these Terms limits Stylingo’s obligations regarding the quality, safety, suitability or supply of goods and services where those obligations are imposed by law.

Where loss or damage results from Stylingo’s unlawful conduct, negligence or failure to fulfil a legal obligation, liability will be determined in accordance with applicable South African law.

SECTION 14 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for any loss, damage, claim or reasonable cost incurred by Stylingo as a direct result of your unlawful use of the website, your infringement of a third party’s rights, or your material breach of these Terms.

SECTION 15 - SEVERABILITY

If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary to make it lawful and enforceable.

If modification is not possible, the affected provision will be treated as severed from these Terms.

The remaining provisions will continue to apply to the extent permitted by law.

SECTION 16 - TERMINATION

These Terms remain applicable while you access or use the Stylingo website or services.

We may suspend or restrict access to the website where reasonably necessary, including in response to fraud, unlawful activity, security threats, abuse, misuse or a material breach of these Terms.

Suspension or termination of website access does not automatically cancel an order or transaction that has already been concluded. Existing orders, payments, refunds, delivery obligations and other rights and responsibilities will continue to be governed by these Terms, the relevant order confirmation, our applicable policies and South African law.

You may stop using the website at any time.

Nothing in this section limits any cancellation, refund or other rights available to you under applicable South African law.

SECTION 17 - ENTIRE AGREEMENT

These Terms, together with the policies referred to on this website and any applicable order confirmation, quotation, artwork approval or other written agreement between you and Stylingo, form the agreement governing the relevant transaction.

For promotional, corporate and custom-branded projects, the specific terms contained in an accepted quotation, order confirmation or approved project documentation will apply to that project. If there is a direct conflict between those project-specific terms and these general Terms, the project-specific terms will apply to the extent of the conflict, subject to applicable law.

A failure or delay by either party to exercise a right under these Terms does not amount to a waiver of that right.

Nothing in these Terms excludes any rights or obligations imposed by applicable South African law.

SECTION 18 - GOVERNING LAW

These Terms and any transaction or agreement between you and Stylingo are governed by the laws of the Republic of South Africa.

Nothing in this section prevents a consumer from exercising any right to approach a court, tribunal, regulator, ombud or other dispute-resolution body that has jurisdiction under South African law.

SECTION 19 - CHANGES TO TERMS OF SERVICE

We may update these Terms from time to time to reflect changes to our business, website, services or applicable law.

The current version will be published on this website and will apply from the date of publication.

Changes to these Terms will apply prospectively and will not alter the agreed terms of an order or transaction that was concluded before the change, unless the change is required by law or is agreed with you.
